1. Acceptance of Terms
By creating an account or using any service provided by ServersRack, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services
ServersRack provides dedicated servers, cloud VPS, and managed hosting services. All services are provided on a subscription basis billed monthly, annually, or as otherwise specified at the time of order.
Service specifications, pricing, and availability are subject to change. We will notify active customers of material changes with reasonable notice.
3. Payments
All payments are processed in USD via cryptocurrency. Accepted currencies include USDT (TRC20/ERC20), BTC, ETH, and LTC. Prices displayed are in USD; you pay the equivalent in your chosen cryptocurrency at the time of checkout.
Services are activated upon confirmed payment. Payments are non-refundable once a server has been provisioned or a service has been activated, except where required by applicable law.
Unpaid invoices may result in service suspension after 3 days and termination after 7 days. Terminated services and associated data are not recoverable.
4. Acceptable Use
You may not use ServersRack services for any illegal activity, including but not limited to: unauthorized access to systems, distribution of malware, spam, phishing, copyright infringement, or any activity that violates applicable law.
Abuse of network resources, including DDoS attacks or hosting content that facilitates attacks on third parties, will result in immediate termination without refund.
ServersRack reserves the right to suspend or terminate any account that violates this policy at its sole discretion.
5. Uptime and SLA
We target 99.99% network uptime. Scheduled maintenance windows are excluded from SLA calculations. SLA credits, where applicable, are issued as account credit and do not constitute a cash refund.
6. Data and Backups
You are solely responsible for maintaining backups of your data. ServersRack is not liable for data loss resulting from hardware failure, human error, or service termination. Automated backup add-ons are available for Cloud VPS plans.
7. Limitation of Liability
ServersRack's total liability to you for any claim arising from these terms or the use of our services shall not exceed the amount you paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
8. Termination
Either party may terminate service at any time. You may cancel by submitting a support ticket. We may terminate your account for violation of these terms, non-payment, or at our discretion with 30 days' notice except in cases of abuse.
9. Governing Law
These terms are governed by the laws of the applicable jurisdiction. Disputes shall be resolved through good-faith negotiation before any formal proceedings.
